1. Scope

These general terms and conditions (Terms) apply to all contracts concluded between Massing Labs GmbH (Provider) and the user (Customer) regarding the use of the Massing Labs platform.

2. Subject of the Contract

The subject of the contract is the provision of a web-based platform for creating architectural visualizations using artificial intelligence.

3. Registration and User Account

Use of the platform requires registration. The customer is obliged to provide truthful and complete information during registration.

4. Services and Credits

The provider provides the customer with a certain quota of credits depending on the selected plan.

• Monthly credits expire at the end of the respective billing period
• Additionally purchased credits (top-ups) remain until used
• Refund of unused credits is excluded

5. Prices and Payment

The currently valid prices can be viewed on the provider's website. Payment is processed via the payment service provider Stripe.

6. Duration and Termination

The contract runs for an indefinite period and can be terminated at any time at the end of the respective billing period.

7. Usage Rights

The customer receives a simple, transferable, unlimited usage right in terms of time and space for images created with the platform for commercial and non-commercial purposes.

8. Liability

The provider is liable without limitation for intent and gross negligence.

9. Privacy

The processing of personal data takes place in accordance with our privacy policy.

10. Final Provisions

The law of the Federal Republic of Germany applies. Place of jurisdiction is Berlin.
